Access to justice
The Constitution of Rwanda clearly protects fundamental human rights which are supported by the principles rule of law, good governance and due process. However, the justice sector faces numerous challenges including: the persistence of genocide ideology, lack of affordable and accessible justice for all, lack of accessible legal advice/aid/representation, and considerable case backlog in judicial system including a large number of family disputes, the need to build the capacity of personnel. Furthermore, while legal systems and structures have improved there still remain gaps such as knowledge of rights and understanding of procedures among the general public, interest based justice and also for Justice, Reconciliation, Law and Orders Sector (JRLOS) officials, especially in the rural areas. There is indeed growing recognition that access to justice is foundational to economic and social development. TUBIBE AMAHORO maintains that the “inability to resolve legal problems diminishes access to sustainable livelihood opportunity, reinforces the poverty trap, and undermines human potential and inclusive growth.”
TUBIBE AMAHORO believes that social Justice can’t be achieved without strengthening Justice and Alternative Dispute resolution mechanisms. In this regard, TUBIBE AMAHORO support paralegals to facilitate the provision of legal aid and strengthening mediation structures to ensure universal and affordable quality justice is achieved. TA has different objective to achieve in this intervention:
- Objective 1: By 2030, TA and partners jointly organized human rights policy and laws capacity developmentsessions for 100 % of organization focal persons and at least 60% of citizens in the operational area;
- Objective 2: By the end of 2030, 60% of citizen’s raised legal issues and people-focused measurement concerns in relation to legal policy implementation and laws are advocated for towards duty bearers at local and national level.
